  1. CHANGES TO THESE TERMS

We amend our terms from time to time. Every time you wish to use our Site, please check these terms to ensure you understand the terms that apply at that time.

These terms were most recently updated on February 2023.

  1. ACCOUNT DETAILS

You must treat the account login information you choose or are provided with (e.g. account number, email address, password) as part of our security procedures as confidential. You must not disclose that information to any third party.

If you know or suspect that anyone other than you knows your login information, you must promptly tell us using the contact details above.

  1. PLACING AN ORDER

To order, you will need to login with your email address or account number and your password. If it is your first order, you will need to register for an account. After adding products you wish to buy to your basket, you can proceed to the checkout to review your order and you will then need to accept the terms and conditions, choose your delivery address and pay.

The quantity of products sold in any one transaction or in multiple transactions may be restricted.

There may be other reasons why products cannot be dispatched (e.g. because they are out of stock or if a pricing error is identified).

Images of Products are for illustration only. We take care to display colours but cannot guarantee that a device’s display will be completely accurate. Products may vary slightly from those displayed.

  1. PRICES

We use our best efforts to ensure that prices stated are correct but occasionally products or services are incorrectly priced. If this happens, products may not be dispatched or your order may be cancelled after dispatch. In such circumstances we will refund you.

Please note that prices do not include delivery. For information about delivery, please refer to the final page of payment. Customs duties and taxes are not included in the price

  1. SHIPPING COUNTRIES

This Site only ships to the following countries: Netherlands and Belgium

You can find out more about the delivery fees if you receive the total payment page.

Customers throughout the EU and EEA can browse and order from this Site in accordance with EU Regulation 2018/302 of 28 February 2018 addressing geo-blocking but only for shipping to the countries at the top of this section. This Site is only directed at the countries we ship to as listed above.

You can track your order after you receive your email confirming dispatch.

  1. CANCELLATIONS, RETURNS & GUARANTEES

We will grant you 14 days to judge if your purchase is satisfactory. Within this period you can return the product. You can take a close look at the product just like you would do in a shop and test if it lives up to your expectations. If you have your doubts whether you can still change your product then please contact us on hallo@beneatly.com. If you are not all satisfied with the product then please return it to us in the original packing to the adres on your invoice (Celsiusstraat 9, 1097 PC Amsterdam) with 1 invoice added. We will refund your money including the original delivery costs (if applicable) within 14 days. You only have to pay yourself for the return shipment.

Beneatly products come with a 10-year guarantee for production errors or material errors.

We advise you to keep the invoice number with your order number, and in case of complaints, we can handle it as soon as possible with this information.

If you have purchased a product and something is wrong with it, please contact hallo@beneatly.com so that we can provide an appropriate solution.

  1. INTELLECTUAL PROPERTY

All intellectual property rights (including copyright, trade mark rights, know-how, moral rights and other intellectual property rights) over all material and content (including, for example, trade marks, logos, text, images, web pages, sound, software, software code, interfaces, website structure and videos) in and on this Site are owned by or licensed to us, Beneatly, Brandmotion, unless otherwise indicated.

Your use of the Site and its contents grants no rights to you in relation to our intellectual property rights, our other exclusive rights, or those rights of third parties in either the Site or its contents. You must not use any material or content in or on this Site for any purpose other than for the purpose for which it was made available by us to you without first obtaining a written licence from us or our licensors.

If you have your own non-commercial website and you would like to link to this Site’s homepage, you can write to us at hallo@beneatly.com and we may allow you to create such a link. If we do allow this, however, it will be on the basis that you will not obtain any rights, title or interest in content or material and we may impose certain conditions (e.g. that links must be fair and legal; must not damage or take advantage of our reputation; and must not suggest any association with, or endorsement by, us).

This Site must not be framed on any other site, nor may any link be created to any other part of it.

We reserve the right to withdraw linking permissions without notice.

We, like other retailers, use reasonable efforts to ensure that this Site (including any content on it and any website accessible from it) is free from viruses, bugs and other malicious or harmful content but we cannot guarantee this or that your computer or other device will not be damaged.   1. OTHER IMPORTANT TERMS

These terms and conditions are between you and us and no other person will have any right to enforce any of these terms and conditions.

These terms and conditions, their subject matter and their formation, are governed by Dutch law. An amicable solution through an ombudsman system will be considered before any judicial remedies. If no solution is reached, the Dutch courts will have non-exclusive jurisdiction to hear any dispute. However, this provision shall not deprive the EU/EEA consumers of their statutory rights.

This site is only targeted at people residing in the countries we ship to as listed in section 5 above. We will not be liable for breach of laws in countries we do not ship to.
